    The “NEW” ABC’s of UAC Law!  What every HR Leader needs to know.

     

    Description of the Presentation:

    On June 27th, 2011, Governor Rick Scott signed into law the most significant changes to Florida’s unemployment compensation law in over a generation.  The new provisions dramatically affect the benefits a claimant may receive from the state, changes the qualifications needed to receive benefits, alters the appeals of benefit determinations, and may have a significant impact on employers’ UC taxes.

    This session will address these legislative changes and what a claimant, employer, and HR must understand to present its case.

    Key learning objectives or key “take-aways” for the Presentation:

    Participants will be able to:

    Understand the new “Rule of Liberal Construction” in the statute and how that may affect which side has a better standing under the law.
    Discover the new definitions of what constitutes disqualifying misconduct when an employee is terminated to relieve the employer’s tax account from charging.
    Learn how to establish a “Prima Facia” case necessary to appeal a case and how an employer may now use certain heresay evidence, previously inadmissible , to make its case
    Review the other germane provisions of the law that were enacted to assist employers and aid in lowering the tax implications for businesses.

    Speaker Bio:  Commissioner Thomas Epsky is serving his third term as a member of the Unemployment Appeals Commission, a quasi-judicial tribunal which is the highest level administrative appeal body in the state of Florida for Unemployment Compensation claims.  The commission is charged with all duties and responsibilities to adjudicate UC cases under Florida law.  In addition to his position with the state, Mr. Epsky is an adjunct faculty member at Indian River State College, instructing and facilitating courses in a wide range of business, legal, and HR subject matter.  He has earned a Master of Science in HR Leadership and holds an SPHR certification.  Mr. Epsky is a past president of the HR Martin SHRM Chapter as well as executive office on the HR Florida State Council. He currently serves on the United Way of Florida Board of Governors.
